The protection of your personal data is a priority for Iana Khachaturova, therefore, under Regulation No. 2016/679 of the European Parliament and of the Council, of April 27, 2016 (General Regulation on the Protection of Personal Data), we are pleased to communicate our Privacy Policy, which will inform you of the new rules applicable to the processing of your personal data, your rights, as well as informing you of how you can manage, directly and in a simple way, the respective consents.
The rules set out in this Privacy Policy complement the provisions on the protection and processing of personal data set out in the “General Conditions of the store www.vintagebyiana.pt”, which regulate the offer of our products and are duly announced on the website, being accepted by the Customer.
This Privacy Policy applies exclusively to the collection and processing of personal data carried out by Iana Khachaturova
Who are we?
Your data will be processed by Iana Khachaturova, Individual businesswoman with registered office in Tv. Venceslau de Morais 3, 2400-094 Leiria, Portugal, registered under the tax identification number 286728796, (hereinafter referred to as Vintage by Iana).
The company Vintage by Iana is responsible for the processing of your personal data, within the meaning of the General Data Protection Regulation (hereinafter referred to as GDPR).
What are personal data?
Personal data is any information, of any nature and regardless of the respective medium, including sound and image, relating to an identified or identifiable natural person.
An identifiable person is one who can be identified directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, electronic identifiers or to one or more elements specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
What type of personal data do we collect?
Within the scope of its activity, the Vintage by Iana will collect and process the personal data necessary for the sale and delivery process of the goods purchased by the Customer, in particular name, address, telephone number, email address, payment data, Internet Protocol (IP) address, tax identification number.
Why do we process your information?
Your personal data may be collected and processed by Vintage by Iana for the following purposes:
a) compliance with legal obligations to which the Vintage by Iana is subject to, notably, invoicing of acquired goods;
b) fulfillment of contractual obligations of the Vintage by Iana notably for the purposes of the logistical process of delivering purchased goods;
c) contact and complaints management effects;
d) contact effects, within the scope of the company’s marketing strategies Vintage by Iana, with information and commercial communications, namely by sending newsletters.
Failure to provide personal data for the purposes set out in paragraphs a) and b) implies non-compliance on the part of the Vintage by Iana, of contractual and legal obligations imposed on it, a situation that constitutes grounds for not concluding the purchase and sale contract by the Vintage by Iana, without the right to any compensation or compensation.

Why do we process your information?
The processing of your personal data will be carried out based on the execution of the product purchase and sale contract concluded with the Vintage by Iana, and in strict compliance with legal obligations imposed on the Vintage by Iana, namely in matters of tax legislation (see paragraphs b) and c) of paragraph 1 of article 6 of the GDPR).
For the purpose set out in paragraph c) of the previous item, the Vintage by Iana will process personal data, based on the legitimate interest pursued by him, as well as that of the Customer (cf. point f) of paragraph 1 of article 6 of the GDPR).
Furthermore, the lawfulness of the processing of personal data collected for the purpose set out in paragraph d) of the previous item is based on the consent given by the Vintage by Iana for the respective processing (cf. point a) of paragraph 1 of article 6 of the GDPR).
How long do we keep your information?
Without prejudice to legal, regulatory provisions or judicial determination to the contrary, the personal data collected will be kept only for the minimum period necessary for the purposes that motivated their collection or subsequent processing.
The most relevant retention periods that we define for the purposes of using your personal data are as follows:
i. Transaction management – legal term of 10 years;
ii. Customer management in loyalty programs – 3 years
iii. Marketing – 2 years (plus current year) since the last interaction;
iv. Management of website or platform users – 1 year (plus current year) after last access;
v. Home deliveries – 2 years;
vi. Warranties and after-sales support – 2 years or equal to the warranty period if longer;
vii. Registration and proof of transactions for distance contracts – 6 months after the contract period;
viii. Service management – 2 years since the last service.
To whom can we transmit your personal data?
Possibly, a Vintage by Iana You may have to share some of your personal data with other recipients, which include:
a) Organizations and/or companies affiliated with Vintage by Iana, as long as they respect an equivalent policy on the protection of personal data;
b) Public Entities to which the Vintage by Iana is legally obliged to provide information, especially to the DGCI – General Directorate of Taxes;
c) Subcontractors who provide certain services related to your personal data under the cover of a subcontract and for the sole purpose of providing technical assistance to Vintage by Iana, which include, but are not limited to, website hosting providers, email and marketing service providers;

Is your data transferred to countries outside the European Union?
Your personal data, collected by Vintage by Iana, will not, as a rule, be transferred to any entity established outside the territory of the European Union.
Exceptionally and under certain conditions, the Vintage by Iana You may transfer your personal data to countries outside the territory of the European Union, in accordance with applicable legislation, for the purposes of data hosting or storage, technical subcontracting of processing, back-up and recovery of hosted data, development of services.

What are your rights?
In accordance with the provisions of the GDPR, you may request, at any time:
a) access to your personal data:You have the right to obtain confirmation as to whether or not personal data concerning you are being processed and, if applicable, the right to access your personal data and the information provided for in the GDPR.
b) the rectification of your personal data:has the right to obtain from Vintage by Iana, without undue delay, the rectification of inaccurate personal data concerning you.
c) the deletion of your personal data:has the right to obtain from Vintage by Iana, without undue delay, the erasure of your personal data, and the Vintage by Iana delete your personal data, without undue delay, when one of the following reasons applies, in particular: 1)personal data are no longer necessary for the purpose for which they were collected or processed; 2) the holder of personal data withdraws the consent on which the processing of the data is based (when it is based on consent) and if there is no other legal basis for said processing; 3) the data subject opposes the processing and there are no prevailing legitimate interests that justify the processing;
d) limitation of the treatment carried out:has the right to obtain from Vintage by Iana the limitation of processing, if one of the following situations applies: 1)contest the accuracy of personal data, for a period that allows the Vintage by Iana check its accuracy; 2) the processing is unlawful and the data subject opposes the erasure of personal data and requests, in return, the limitation of its use; 3) a Vintage by Iana personal data is no longer needed for processing purposes, but such data is required by the holder for the purposes of declaring, exercising or defending a right in legal proceedings; 4) if you have objected to the processing, until it is verified that the legitimate reasons for the Vintage by Iana prevail over those of the data subject.
e) the right to object to the processing:when the processing is carried out for the purposes of the legitimate interests pursued by the Vintage by Iana, The data subject has the right to object at any time, for reasons related to his or her particular situation, to the processing of personal data concerning him or her. THE Vintage by Iana will cease the processing of personal data, unless it presents compelling and legitimate reasons for such processing and which prevail over the interests, rights and freedoms of the data subject, or for the purposes of declaring, exercising or defending a right in legal proceedings.
f) the right to data portability:under the terms and conditions defined by law, you have the right to receive the personal data that concerns you and that you have provided to Vintage by Iana, in a structured, commonly used and machine-readable format, and the right to transmit these data to another controller without the controller to whom the personal data were provided being able to prevent this, if: 1)The processing is based on consent or a contract; and 2) The processing is carried out by automated means.
If the requests presented are manifestly unfounded or excessive, notably due to their repetitive nature, the Vintage by Iana may (i) demand payment of a reasonable fee taking into account the administrative costs of providing the information or communications, or taking the requested action, or (ii) refuse to comply with your request.
Regarding personal data whose processing by Vintage by Iana is legitimized in the consent granted by him, he is granted the right to withdraw consent, without the exercise of such right being able to compromise the lawfulness of the processing carried out based on the consent previously given, nor the subsequent processing of the same data, based on another legal basis, such as the fulfillment of a contractual or legal obligation to which the Vintage by Iana be subject.
