Article 1.<\/b><\/p>

(Scope and Definitions)<\/b><\/p>

  1. <\/b>These general conditions apply to all transactions carried out when purchasing products through the website with the address <\/span>www.vintagebyiana.pt<\/b>, including registration and order.<\/span><\/li>
  2. <\/b>For the purposes of these general conditions, the following definitions apply:<\/span><\/li>
  3. <\/b>Iana Khachaturova<\/b>, <\/span>individual entrepreneur<\/span> with registered office in <\/span>Travessa Venceslau de Morais, 3, 2400-260 Leiria<\/span>, registered under the tax identification number <\/span>286728796<\/span>, holder of all copyrights and related rights to the website with the address <\/span>www.vintagebyiana.pt<\/b>, as well as other rights that may be subject to protection provided for in the Industrial Property Code;<\/span><\/li>
  4. <\/b>\u201c<\/span>Customer<\/b>\u201d: any entity that places an order through the website with the address <\/span>www.vintagebyiana.pt<\/b><\/li>
  5. <\/b>These general conditions do not affect the Customer's statutory rights and guarantees under the legislation in force for contracts of this nature.<\/span><\/li>
  6. <\/b>Iana Khachaturova<\/b>, reserves the right to change these \u201cGeneral Conditions of Sale\u201d, without prior notice, making the necessary changes to the website and ensuring that these changes will not affect purchases that have already been made before their implementation.\u00a0<\/span><\/li>
  7. <\/b>All pieces available in the store are vintage and may show natural signs of patina, which are part of their history, authenticity and unique character.<\/span><\/li>
  8. <\/b>Each item is carefully selected, inspected and described with the utmost accuracy. Whenever there are visible signs of use or small imperfections, these are indicated in the description and\/or visible in the photographs. Colors may vary slightly due to lighting or screen settings.<\/span><\/li>
  9. <\/b>The order is considered confirmed upon receipt of payment.<\/span><\/li><\/ol>

    Article 2.<\/b><\/p>

    (Registration)<\/b><\/p>

    1. <\/b>To place an order, the Customer must be registered and can do so through the website with the address <\/span>www.vintagebyiana.pt<\/b>, by filling in the fields contained in the form available there.<\/span><\/li>
    2. <\/b>After registering as a Customer, you will be able to access your personal account online, logging in using the personal and non-transferable password chosen by you at the time of registration.<\/span><\/li>
    3. <\/b>From the moment you log in to the website <\/span>www.vintagebyiana.pt<\/b>, the Customer is subject to these general conditions, as well as the legal and regulatory standards that govern its operation and use.<\/span><\/li><\/ol>

      \u00a0<\/span><\/p>

      Article 3.<\/b><\/p>

      (Order)<\/b><\/p>

      1. <\/b>To place an order, the Customer must access their personal account online, on the website <\/span>www.vintagebyiana.pt<\/b>, by logging in using your email and password, and selecting the product or products available for sale online, completing the order with confirmation of the delivery address, tax identification number and final validation of the order.<\/span><\/li>
      2. <\/b>After final validation of the order, the Customer will receive an automatic \u201cOrder Confirmation\u201d email message, which will be subject to analysis by the company\u2019s internal services. <\/span>Iana Khachaturova<\/b>, in order to assess the delivery conditions of the product or products ordered. This phase is intended to be as short as possible, preferably completed on the same day.<\/span><\/li>
      3. <\/b> \u00a0 \u00a0 An email message will be sent, indicating the availability of the material and including a Delivery Note, which details the information necessary for effective payment, namely ATM Reference (Multibanco) or IBAN for Bank Transfer. Possibly, at this stage, if clarification is needed, telephone contact may be made.<\/span><\/li>
      4. <\/b> \u00a0 After identification of effective receipt, an email message will be sent, indicating the link that will allow you to track the delivery of the order via the website <\/span>www.vintagebyiana.pt<\/b>.<\/b><\/li>
      5. <\/b>Order tracking can also be done via the \u201cMy Account\u201d link, found in the Customer\u2019s personal account on the website. <\/span>www.vintagebyiana.pt<\/b>.<\/span><\/li>
      6. <\/b>The final validation of the order constitutes, on the part of the Customer, a declaration of full and unconditional acceptance of the deal concluded, including acceptance of these General Conditions of Sale, the legal and regulatory standards that regulate purchases of this nature, the price and characteristics of the product ordered, with the consequent mutual demandability (to the Customer and the <\/span>Iana Khachaturova<\/b>) of the services contained in the order communication document.<\/span><\/li>
      7. <\/b>The products available for order can be found on the website <\/span>www.vintagebyiana.pt<\/b>.<\/span><\/li><\/ol>

        \u00a0<\/p>

        Article 4.<\/b><\/p>

        (Price and product characteristics)<\/b><\/p>

        1. <\/b>Prices of products for sale on the website <\/span>www.vintagebyiana.pt<\/b> They are priced in Euros (\u20ac) and include VAT at the legal rate in force, unless otherwise indicated.<\/span><\/li>
        2. <\/b>The prices indicated\u00a0<\/span>do not include shipping costs<\/b>, known as shipping costs, which will be added to the total value of the order, after selecting the type of shipping from the available options.<\/span><\/li><\/ol>
          1. <\/b>Prices of products listed on the website <\/span>www.vintagebyiana.pt<\/b> may be modified at any time, without the need for prior notice, but not after acceptance of the Customer's order by <\/span>Iana Khachaturova<\/b>.<\/b><\/li>
          2. <\/b>The products made available by <\/span>Iana Khachaturova<\/b>, are presented on the website <\/span>www.vintagebyiana.pt<\/b>, accompanied by a description of their characteristics, meaning that the Customer was aware of them before placing the order.<\/span><\/li>
          3. <\/b>With confirmation of the order, the purchase and sale contract for the products is formalized, as well as the inherent delivery service.<\/span><\/li>
          4. <\/b>After confirming the order, an email will be sent to the customer with a summary of the order.<\/span><\/li>
          5. <\/b>The order will be delivered to the address indicated by the customer who makes the payment by Multibanco or MBWay, or another means made available, prior to receiving the order.<\/span><\/li>
          6. <\/b>For items sold by weight, this will be approximate and may undergo changes and variations.<\/span><\/li>
          7. <\/b>Use of the website\u00a0<\/span>www.vintagebyiana.pt<\/b>, does not involve any additional cost.<\/span><\/li>
          8. <\/b>The minimum value of shipping costs through CTT Express or another logistics operator in the <\/span>Iana Khachaturova<\/b> for is from:\u00a0<\/span><\/li><\/ol>

            10.1 Portugal Continental \u2013 <\/b>Free shipping on purchases from <\/span>40\u20ac; <\/b>For orders under \u20ac40, the shipping cost is <\/span>5,69\u20ac; <\/b>Estimated delivery time: <\/span>1 to 2 business days<\/b><\/p>

            10.2 Azores and Madeira<\/b> \u2013 Shipping cost: <\/span>7,49\u20ac<\/b>, regardless of the order value; <\/span>Estimated delivery time: <\/span>1 to 2 weeks<\/b><\/p>

            10.3 Shipping to Europe \u2013 <\/b>Shipments are made to European countries.<\/span>\u2028<\/span>The shipping cost is calculated according to the weight of the order and the country of destination.<\/span>\u2028<\/span>For more information, prior contact is recommended before finalizing the purchase; <\/span>All orders are packed with the utmost care, ensuring protection and safety during transport.<\/span><\/p>

            1. <\/b>Notwithstanding the provisions of the previous paragraphs, the values \u200b\u200bmentioned are subject to change, without the need for prior notice, and the Customer may check the value of the shipping costs to be charged at the time of completing the order.<\/span><\/li>
            2. <\/b>Iana Khachaturova<\/b> may be made available on the website <\/span>www.vintagebyiana.pt<\/b> other delivery services, with prices varying depending on the method chosen by the Customer.<\/span><\/li>
            3. <\/b>For more information regarding shipping costs, the Customer may contact <\/span>Iana Khachaturova<\/b> via email address<\/span> geral@vintagebyiana.pt<\/b>.<\/b><\/li>
            4. <\/b>Iana Khachaturova<\/b> reserves the right to ship ordered products free of charge (\u201cfree shipping\u201d), this possibility being expressly indicated on the website <\/span>www.vintagebyiana.pt<\/b> and, if applied, will be mentioned at the time of completing the order.<\/span><\/li><\/ol>

              \u00a0<\/p>

              Article 5.<\/b><\/p>

              (Delivery)<\/b><\/p>

              1. <\/b>Iana Khachaturova<\/b> will ship the product(s) ordered by the Customer through the logistics operator, to the address indicated by the Customer when confirming the order, which may be different from the address indicated for billing.<\/span><\/li>
              2. <\/b>Deliveries will be made on the days and times used by the logistics operator.<\/span><\/li>
              3. <\/b>The company <\/span>Iana Khachaturova<\/b> will not deliver any product to PO boxes.<\/span><\/li>
              4. <\/b>The company <\/span>Iana Khachaturova<\/b> undertakes to ship the order within a maximum period of 5 (five) business days after payment confirmation.<\/span><\/li>
              5. <\/b>In case of unavailability of the product, notably due to stock out, the <\/span>Iana Khachaturova<\/b> will inform the Customer, and may proceed with its replacement upon acceptance by the customer, with the Customer not being granted any right to any compensation for this situation.<\/span><\/li>
              6. <\/b>Transport time is added to the deadlines stipulated in the previous numbers, which will depend on the logistics operator and the destination of the order.<\/span><\/li>
              7. <\/b>When delivering the order, the logistics operator collects the signature of whoever receives it at the address indicated by the Customer, after carefully inspecting it. Refusal to sign the delivery document implies the recording of such fact in said document and non-delivery of the order to the Customer.<\/span><\/li>
              8. <\/b>If the order is damaged, the Customer must refuse delivery, or accept it with reservations, stating them on the delivery document.<\/span><\/li>
              9. <\/b>For the purposes of the previous paragraph, the Customer must also contact the <\/span>Iana Khachaturova<\/b>, via the address <\/span>geral@vintagebyiana.pt<\/span><\/a> within a maximum period of <\/span>2 days after receipt, <\/b>including the following elements:<\/span> photographs of the outer packaging before opening; photographs of the inner packaging; clear photographs of damaged items. Without these elements, it will not be possible to proceed with the complaint process.<\/span><\/li>
              10. <\/b>If it is not possible to deliver the order, the logistics operator will leave a notice in the Customer's mailbox, and the Customer must contact the operator directly in order to schedule a new delivery during business hours, within a maximum period of 1 (one) business day.<\/span><\/li>
              11. <\/b>If the order cannot be successfully delivered on the new date, due to a fact attributable to the Customer, the order will be returned to <\/span>Iana Khachaturova<\/b>.<\/b><\/li>
              12. <\/b>If the Customer does not receive the order under the terms set out in the previous paragraphs, and it is returned, the purchase will be cancelled.<\/span><\/li>
              13. <\/b>The company <\/span>Iana Khachaturova<\/b> cannot be held responsible for delays in the delivery of ordered products, when this results from an event of force majeure or fortuitous event, namely situations of strike, pandemic, acts of war or terrorism, riots, blockades, insurrections, acts of sabotage, earthquakes, tornadoes, hurricanes, storms, fires, floods or other extreme climatic or environmental conditions, as well as for any act of public authority, as long as it is not attributable to the <\/span>Iana Khachaturova<\/b>.<\/b><\/li>
              14. <\/b>In the event of any force majeure event or fortuitous event, the delivery period for the ordered products will be extended until the moment in which compliance with the obligation is possible.<\/span><\/li>
              15. <\/b>After 4 (four) months have passed without the reason for force majeure having ceased, either Party has the right to terminate the contract on such grounds.<\/span><\/li><\/ol>

                \u00a0<\/span><\/p>

                Article 6.<\/b><\/p>

                (Returns policy)<\/b><\/p>

                1. <\/b>The company <\/span>Iana Khachaturova<\/b> will accept returns when legally required.<\/span><\/li>
                2. <\/b>Under the terms of <\/span>Decree-Law No. 24\/2014<\/b>, from February 14th, the customer has a period of <\/span>14 days<\/b> upon receipt of the request to exercise the right of withdrawal. To do this, you must communicate your intention to return in writing within this period.<\/span><\/li>
                3. <\/b>The CUSTOMER cannot freely terminate contracts for: <\/span>a)<\/strong> Supply of goods made according to consumer specifications or clearly personalized; b)<\/strong> Supply of goods that, by nature, cannot be resent or are susceptible to deteriorating or becoming quickly out of date; <\/span>c)<\/strong> Supply of sealed goods that cannot be returned, for reasons of health protection or hygiene when opened after delivery; <\/span>d)<\/strong> Supply of goods that, after delivery and by nature, are inseparably mixed with other items; <\/span>e)<\/strong> Supply of newspapers, periodicals or magazines, except subscription contracts for sending these publications;<\/span><\/li>
                4. <\/b>To return the product, it must be in perfect condition, in its original packaging, not damaged, altered or erased, and with all accessories or promotional offers, if included, and also duly accompanied by proof of purchase or invoice.<\/span><\/li>
                5. <\/b>After receiving the product and checking its perfect condition, the <\/span>Iana Khachaturova<\/b> will accept the return of the product, refunding it within 30 days.<\/span><\/li>
                6. <\/b>In case of out of stock, it will be <\/span>Iana Khachaturova<\/b> reimbursement of the amount paid by the Customer, using the same payment method used by the Customer in the initial transaction.<\/span><\/li>
                7. <\/b>The refund provided for in the the aforementioned paragraph will be made based on the price actually paid for the product, excluding shipping costs.<\/span><\/li>
                8. <\/b>With the exception of the provisions in the following paragraph, all expenses arising from returning the order will be borne by the Customer.<\/span><\/li>
                9. <\/b>In any case, the return of defective products and\/or incorrect shipments will be permitted, with the company being responsible. <\/span>Iana Khachaturova<\/b> for shipping and return costs whenever the Customer communicates this circumstance to the address mentioned above, within 1 (one) day from the date of receipt of the products.<\/span><\/li>
                10. <\/b>In the situation foreseen in the previous paragraph, the <\/span>Iana Khachaturova<\/b> assumes responsibility arising from original defects presented by the ordered product, and will exchange the product, or return the amount paid, at no cost to the Customer.<\/span><\/li>
                11. <\/b>Iana Khachaturova<\/b> will not accept the return of damaged products, or that show obvious signs of use, and will not be responsible for deficiencies resulting from incorrect and\/or negligent use, nor for components subject to wear due to normal use of the product.<\/span><\/li>
                12. <\/b>As these are vintage, unique and often fragile pieces, any damage occurring after delivery may compromise acceptance of the return.<\/span><\/li>
                13. <\/b>The Customer may submit their complaints or request for resolution via the email address<\/span> geral@vintagebyiana.pt,<\/b><\/a>, or in writing, to the <\/span>Travessa Venceslau de Morais, 3, 2400-260 Leiria<\/span>.<\/span><\/li><\/ol>

                  \u00a0<\/p>

                  Article 7.<\/b><\/p>

                  (Responsibility)<\/b><\/p>

                  1. <\/b>The company <\/span>Iana Khachaturova<\/b> is not responsible for any damage resulting from the abusive intervention of third parties in the computer system that supports the website, nor for damage resulting from the use of the internet and resulting from the presence of computer viruses or other malicious software.<\/span><\/li>
                  2. <\/b>The website <\/span>www.vintagebyiana.pt<\/b> its exclusive objectives are intermediation in the trade of vintage products <\/span>Iana Khachaturova<\/b> to the Customer, under the conditions indicated, as well as the provision of a personal account to place an order for these products, and the website cannot be used for any other purpose.<\/span><\/li>
                  3. <\/b>The company <\/span>Iana Khachaturova<\/b> will not be responsible for any abusive use by third parties of access data to the website, which is personal and non-transferable.<\/span><\/li><\/ol>

                    \u00a0<\/p>

                    Article 8<\/b><\/p>

                    (Duration)<\/b><\/p>

                    1. <\/b>These General Conditions of Sale apply for the duration of the commercial relationship established between the Customer and the <\/span>Iana Khachaturova<\/b>, celebrated through the website <\/span>www.vintagebyiana.pt<\/b>.<\/b><\/li>
                    2. <\/b>The provisions of the previous paragraph do not affect the possibility of subsequent review or amendment of these conditions by <\/span>Iana Khachaturova<\/b>.<\/b><\/li><\/ol>

                      \u00a0<\/p>

                      Article 9.<\/b><\/p>

                      (Proof and Archive)<\/b><\/p>

                      1. <\/b>The computer records kept in the computer system of the <\/span>Iana Khachaturova<\/b> are considered evidence of the conclusion of the contract between the Parties, as well as the conditions under which it was concluded.<\/span><\/li>
                      2. <\/b>The documents proving orders, and the invoices associated with them, will be archived on a reliable and durable medium.<\/span><\/li><\/ol>

                        \u00a0<\/p>

                        Article 10.<\/b><\/p>

                        (Applicable law and forum)<\/b><\/p>

                        1. <\/b>These General Conditions of Sale are governed, in everything that is omitted, by Portuguese law.<\/span><\/li>
                        2. <\/b>In the event of a dispute regarding the validity, interpretation or application of these general conditions, the Parties will endeavor, through all possible means of dialogue and forms of composition of interests, to obtain a concerted solution to the issue.<\/span><\/li>
